"Crashgate" not to blame for Felipa Massa losing 2008 title, court hears

The High Court has heard that Felipe Massa "overlooked a catalogue of his own errors" regarding his 'Crashgate' claim.

Massa has brought a £64m legal claim forward against Formula One Management, the FIA and Bernie Ecclestone, declaring that he was the rightful winner of the 2008 Formula 1 Drivers' Championship.

Massa lost the title by one point to Lewis Hamilton, with the Singapore Grand Prix playing a crucial role in the outcome. Renault's Nelson Piquet Jr revealed the year after the race that he had been under instruction to crash deliberately, aiding team mate Fernando Alonso.

When pitting during the 2008 Singapore Grand Prix, Massa drove off with the fuel hose still attached to his car and would go on to finish the race 13th, out of the points.

The claim is centred around an interview given by Ecclestone in 2023, in which the F1 boss suggested that the sport's executives were aware of the cover-up before the season concluded but that the FIA failed to investigate.

Ecclestone's lawyer David Quest KC said the claims "are a misguided attempt to reopen the results of the 2008 F1 Drivers' Championship."

He added: "Mr Massa argues that, but for the FIA's handling of the crash, he would have won the Drivers' Championship.

John Mehrzad KC, for the FIA, said Massa's claim is as "torturous as it is overly ambitious" and "conspicuously overlooks a catalogue of his own errors."

Massa is seeking damages for loss of earnings and sponsorship as well as declarations that the FIA acted in breach of its own regulations, and that if it had not done so, it would have cancelled or adjusted the results of the Singapore Grand Prix, with him going on to win the Drivers' Championship.

The hearing is due to conclude on Friday, with a ruling likely coming at a later date.
